Cancellation Policy

For the services provided by Empire Premier Academy, its owners, agents, officers, subcontractors, employees, and anyone else acting on their behalf (hereinafter collectively referred to as "EPA"), I hereby release, discharge and hold harmless EPA on behalf of myself, my children, my parents, my heirs, assigns, and estate.: 1. While on the premises or under the auspices of EPA, I or my child may engage in activities that pose known and unknown risks that may result in injury, paralysis, death, emotional distress, or damage to me, my child, or property. Dance and gymnastics, including stunts and trampolining, involve some risks that cannot be eliminated without jeopardizing their essential qualities. Dance students would not improve their skills and would not enjoy the sport without some risk. Cuts and bruises are common risks associated with dance and gymnastics. Falling, spraining, or breaking wrists or ankles is common. The possibility of transportation accidents increases when traveling to and from shows, meetings, and exhibitions. In any event, if you or your child is injured, medical assistance may be required which you must pay for yourself. 2. I voluntarily assume all risks, known and unknown, associated with EPA-related activities, including stunts and trampolines. No one has pressured me or my child to participate. 3. I release EPA from any liability related to my child's participation in EPA activities voluntarily and forever. 4. Should EPA be required to incur attorney's fees and cost to enforce this agreement, I agree to indemnify and reimburse them for such fees and costs. 6. By filing a lawsuit against the EPA, I agree to only do so in Ohio under its laws. I acknowledge that if any part of this agreement is deemed invalid, the rest will still apply. The substantive and procedural laws of Ohio will govern any legal action, disregarding conflict of laws rules. 7. By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation or the participation of any of my children in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against EPA on the basis of any claim from which I have released EPA by signing this Agreement. I have had sufficient opportunity to read this entire document. I have read it and understand it. I agree to be bound by its terms.
